ADVENTURE COMMUNITY

General Terms of Service

Effective date: August 17, 2026

Important: These Terms govern Adventure Community’s website, media, newsletters, downloads, community areas, and other general online services. Travel planning, trip bookings, hosted events, and other paid travel services may be governed by separate terms presented when you inquire, book, register, or purchase.

These General Terms of Service (the “Terms”) are a binding agreement between you and Adventure Community Co. [insert full legal entity name if different] (“Adventure Community,” “we,” “us,” or “our”). They apply when you access or use [insert primary website URL], any related website, online community, account area, newsletter, form, digital resource, social feature, or other service that links to these Terms (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services. If you use the Services on behalf of a business or organization, you represent that you have authority to bind it, and “you” includes that entity.

1. Scope of These Terms

These Terms cover Adventure Community’s general media and community activities, including articles, destination information, travel news, guides, newsletters, downloadable resources, quizzes, forms, member discussions, comments, and similar content or features.

These Terms do not replace any separate agreement that applies to a specific product or service. Travel planning services, group trips, Weekend Campouts, retreats, hosted experiences, bookings, memberships, paid digital products, promotions, or partner services may have additional terms. If additional terms conflict with these Terms, the additional terms control for that specific product, transaction, or service.

2. Eligibility and Accounts

You may browse publicly available content if you can lawfully enter into these Terms. You must be at least 18 years old to create an account, join a member-only community, submit a purchase, or enter into a paid transaction unless we expressly allow otherwise with a parent or legal guardian’s consent. The Services are not directed to children under 13.

If you create an account, you agree to provide accurate, current information; keep your login credentials confidential; promptly update information that changes; and accept responsibility for activity under your account. You may not share, sell, transfer, or misuse an account. Tell us promptly at [insert support email] if you suspect unauthorized access.

We may refuse registration, require verification, suspend access, or close an account when reasonably necessary to protect the Services, our community, other users, or third parties; investigate suspected misuse; or comply with law.

3. Travel Content Is General Information

Adventure Community publishes travel information based on research, firsthand experience, contributor knowledge, and sources believed to be useful. It is educational and editorial content, not a guarantee and not individualized travel, legal, medical, financial, immigration, safety, or insurance advice.

Travel conditions can change quickly. Prices, schedules, routes, entry requirements, visa rules, health guidance, weather, closures, availability, accessibility, political conditions, and safety information may become outdated without notice. You are responsible for confirming current information with official government authorities, transportation providers, accommodations, tour operators, insurers, medical professionals, and other relevant sources before relying on it or traveling.

Travel involves inherent risks, including illness, injury, crime, severe weather, transportation disruption, political instability, natural hazards, wildlife encounters, and loss or damage to property. You are responsible for deciding whether an activity or destination is appropriate for you and for obtaining appropriate documentation, insurance, vaccinations, medical advice, equipment, and emergency support.

4. No Booking or Agency Relationship Through General Content

Reading content, downloading a resource, subscribing to a newsletter, submitting a general contact form, or participating in a community discussion does not create a travel advisor-client, fiduciary, agency, partnership, joint venture, employment, or other professional relationship with Adventure Community.

A travel planning or booking relationship begins only when we expressly accept the engagement and the parties complete any required consultation, agreement, payment, or booking process. Separate Travel Planning Terms of Service or supplier terms will apply.

5. Editorial Independence, Affiliate Links, and Sponsored Content

Some content may include affiliate links, referral links, sponsored content, gifted experiences, advertising, or other commercial relationships. If you use an affiliate link or referral code, we may receive a commission or other benefit, sometimes at no additional cost to you. We will make disclosures where required.

A commercial relationship does not guarantee a favorable review, recommendation, ranking, or continued inclusion. Opinions are our own or those of the identified contributor. You are responsible for evaluating whether a recommendation is right for you.

6. Community Standards and Acceptable Use

Adventure Community is intended for useful, respectful exchange among travelers. When you post, upload, comment, message, submit, or otherwise interact through the Services, you agree not to:

  • harass, threaten, bully, stalk, demean, exploit, or discriminate against another person;
  • post content that is unlawful, defamatory, obscene, fraudulent, deceptive, hateful, sexually exploitative, or invasive of privacy or publicity rights;
  • promote unsafe, illegal, abusive, exploitative, or unethical travel practices, including wildlife exploitation or cultural disrespect;
  • impersonate another person or organization, misrepresent your identity or affiliation, or create a false account;
  • post spam, unauthorized advertising, chain messages, scams, malware, or repetitive promotional content;
  • collect, scrape, harvest, or use personal information about other users without permission;
  • circumvent security, interfere with operation of the Services, test vulnerabilities without authorization, or introduce harmful code;
  • copy, crawl, scrape, index, download in bulk, or use automated means to access the Services except as allowed by our robots.txt, a written agreement, or applicable law;
  • use the Services or their content to train, develop, benchmark, or improve an artificial intelligence or machine-learning model without our prior written permission; or
  • encourage, assist, or attempt any prohibited conduct.

We may moderate, remove, restrict, preserve, or disclose content when reasonably necessary to enforce these Terms, protect users, respond to legal process, or operate the Services. We are not required to monitor every communication and do not endorse user statements.

7. User Content

“User Content” means text, reviews, comments, photos, videos, profile information, messages, trip tips, and other material you submit to or through the Services.

You retain ownership of your User Content. You grant Adventure Community a nonexclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, adapt for technical or editorial presentation, publish, display, distribute, and otherwise use your User Content as needed to operate, improve, promote, and provide the Services. This license continues for as long as your User Content is available through the Services and for a reasonable backup, legal, archival, or promotional period afterward. If we want to use your identifiable photo, testimonial, or story in a paid advertisement beyond ordinary promotion of the Services, we will obtain any additional permission required by law.

You represent that you own or have all rights and permissions necessary for your User Content; your submission and our permitted use will not violate another person’s intellectual property, privacy, publicity, contractual, or other rights; and your User Content is accurate to the best of your knowledge when presented as fact.

Do not post sensitive personal information, travel documents, payment details, precise live locations, private communications, or information about another person without permission. Public posts may be copied or shared by others, and we cannot control uses outside the Services.

8. Feedback and Submissions

If you voluntarily provide ideas, suggestions, or feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation. This does not transfer ownership of separately submitted creative work unless you expressly agree in writing.

9. Adventure Community Content and Intellectual Property

The Services and their original articles, guides, copy, graphics, branding, logos, photographs, videos, site design, compilations, and other content are owned by or licensed to Adventure Community and are protected by intellectual property laws. “Adventure Community,” related names, logos, and brand elements may not be used without permission.

We grant you a limited, personal, nonexclusive, nontransferable, revocable license to access the Services and use our content for your own noncommercial informational purposes. You may share links and brief excerpts with clear attribution. You may not reproduce, republish, sell, license, distribute, modify, remove notices from, create derivative works from, or commercially exploit our content without prior written permission, except where applicable law allows.

10. Copyright Complaints

We respect intellectual property rights. If you believe material on the Services infringes your copyright, send a written notice to our designated copyright contact at [insert DMCA/copyright email and mailing address] that includes:

  • your physical or electronic signature;
  • identification of the copyrighted work claimed to be infringed;
  • identification and location of the allegedly infringing material;
  • your name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or law; and
  • a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the copyright owner.

We may remove or restrict material in response to a valid notice and may terminate repeat infringers where appropriate. If Adventure Community seeks safe-harbor protection under the Digital Millennium Copyright Act, it should also register and maintain a designated agent with the U.S. Copyright Office.

11. Third-Party Services, Links, and Offers

The Services may link to or integrate with third-party websites, booking platforms, social networks, maps, payment processors, forms, communities, products, accommodations, tour operators, or other providers. Third parties are independent from Adventure Community unless expressly stated otherwise. Their terms and privacy practices govern your use of their services.

We do not control and are not responsible for third-party availability, accuracy, security, conduct, products, services, cancellations, refunds, or performance. A link, mention, directory listing, or integration is not a guarantee or endorsement. Any transaction with a third party is between you and that third party, except to the extent a separate written agreement expressly states otherwise.

12. Purchases, Payments, and Promotions

If we offer a paid digital product, membership, event, or other general service through the Services, the price, billing schedule, renewal terms, cancellation rules, refund policy, and any additional conditions will be disclosed at or before purchase. You authorize the stated charges and agree to provide accurate billing information. Taxes may be added where required.

Unless a checkout page or separate written agreement says otherwise, one-time digital downloads and immediately accessible digital content are nonrefundable after delivery, except where law requires a refund. We may correct pricing or description errors before fulfillment and issue a refund if we cancel an order.

Promotions, giveaways, contests, or sweepstakes may have official rules that control over these Terms for that promotion.

13. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that internet transmissions and storage are not guaranteed to be completely secure.

If you subscribe to marketing email or text messages, you may withdraw consent using the unsubscribe link, reply instructions, or other method provided. Consent to marketing is not a condition of purchase. Transactional or service messages may still be sent when necessary to administer your account, respond to you, or provide a requested service.

14. Availability, Changes, and Termination

We may add, change, suspend, or discontinue any part of the Services, including features, content, access methods, or availability. We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or compatible with every device or browser.

You may stop using the Services at any time. You may request account closure through [insert support email], subject to legal, safety, payment, recordkeeping, and backup requirements. We may suspend or terminate access for a violation of these Terms, risk to users or the Services, nonpayment, legal requirements, or discontinuation of a feature.

Provisions that by their nature should survive termination will survive, including ownership, licenses already granted, disclaimers, limitations of liability, indemnity, dispute terms, and general provisions.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ADVENTURE COMMUNITY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT CONTENT IS COMPLETE, CURRENT, ERROR-FREE, OR SUITABLE FOR YOUR PARTICULAR TRIP, HEALTH, ABILITIES, BUDGET, RISK TOLERANCE, OR CIRCUMSTANCES; THAT THE SERVICES WILL BE UNINTERRUPTED OR SECURE; OR THAT ANY DESTINATION, PROVIDER, PRODUCT, COMMUNITY MEMBER, OR EXPERIENCE WILL MEET YOUR EXPECTATIONS.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVENTURE COMMUNITY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, CONTRIBUTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES; OR PERSONAL INJURY, PROPERTY DAMAGE, TRAVEL DISRUPTION, OR OTHER LOSS ARISING FROM OR RELATED TO THE SERVICES, CONTENT, USER CONTENT, THIRD-PARTY SERVICES, OR YOUR RELIANCE ON TRAVEL INFORMATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO ADVENTURE COMMUNITY FOR THE GENERAL SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT OR (B) US $100.

These limitations do not exclude liability that cannot lawfully be excluded or limited. Separate terms may state a different liability framework for a paid service, booking, event, or trip.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Adventure Community and its owners, officers, employees, contractors, contributors, affiliates, licensors, and service providers from third-party claims, liabilities, damages, judgments, losses, and reasonable costs (including attorneys’ fees) arising from your User Content, your unlawful or prohibited use of the Services, your violation of these Terms, or your violation of another person’s rights. We may control the defense of a claim subject to indemnification, and you agree to cooperate. You may not settle a claim in a way that admits fault by or imposes obligations on us without our written consent.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Before filing a claim, you and Adventure Community agree to make a good-faith effort to resolve the dispute informally by sending written notice describing the issue and requested resolution. Notices to us must be sent to [insert legal notice email and mailing address].

If a dispute is not resolved within 30 days after receipt of notice, either party may pursue available remedies. Unless applicable law requires otherwise, the state and federal courts located in Santa Barbara County, California will have exclusive jurisdiction, and each party consents to venue there.

Nothing in this section prevents either party from seeking urgent injunctive relief, bringing an eligible claim in small claims court, reporting a matter to a government agency, or exercising rights that cannot lawfully be waived.

19. Changes to These Terms

We may update these Terms from time to time. We will post the revised version and update the effective date. If a change is material, we may provide additional notice, such as through the Services or by email. Changes apply prospectively from their stated effective date. Your continued use after the effective date means you accept the revised Terms, to the extent permitted by law.

20. General Provisions

These Terms and any applicable additional terms are the entire agreement between you and Adventure Community regarding their subject matter and supersede prior discussions or communications on that subject. If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale of assets, financing, or by operation of law. Headings are for convenience only. “Including” means “including without limitation.” Electronic records and signatures may be used where permitted by law.

PUBLISHING CHECKLIST

Items to confirm before posting

Drafting note: This checklist is for Adventure Community’s internal use and should be removed from the public webpage. The Terms are a general business draft, not a substitute for legal advice from counsel familiar with your entity, products, insurance, and current operations.

  • Replace every bracketed placeholder: legal entity name, website URL, support email, legal-notice email, mailing address, and copyright contact.
  • Confirm the contracting entity and whether “Adventure Community Co.” is a legal name or a DBA. Use the same entity name across the Terms, Privacy Policy, checkout pages, invoices, and footer.
  • Link these Terms to the current Privacy Policy and keep the Privacy Policy separate.
  • Confirm which offerings have separate terms: Travel Planning, Group Trips, Weekend Campouts, retreats, memberships, paid guides, events, and promotions.
  • Match the refund language to the actual checkout experience for digital products, memberships, and events.
  • If users can upload content or participate in a community, decide whether to register a DMCA designated agent and publish the required agent information.
  • Add clear, nearby disclosures to affiliate and sponsored content; do not rely on this Terms document as the only disclosure.
  • Confirm the age rule and whether minors will ever register for events or community access. If yes, add a parent/guardian process and service-specific terms.
  • Confirm Santa Barbara County, California as the intended venue and have counsel review the liability cap, indemnity, and all-caps disclaimer language.
  • Keep an archived copy of each published version and record the effective date whenever the Terms change.
